North Dakota Human Life Amendment Fights Back Against Abortion on Demand

Pro-abortion groups have found a way to undo the will of the people and legislators.

They have been successful at getting judges in sixteen states to overturn prolife laws and impose a “right” to abortion-on-demand: Alaska, Arizona, California, Connecticut, Florida, Illinois, Indiana, Massachusetts, Minnesota, Montana, New Jersey, New Mexico, Oregon, Tennessee, Vermont, West Virginia. And every time, the judge deems the prolife law as unconstitutional.

northdakotaNorth Dakota is fighting back with an historic ballot measure. Measure 1—the Human Life Amendment–was placed on the November ballot by a bi-partisan majority of the legislature. It seeks to add these words to the state constitution: “The inalienable right to life of every human being at any stage of development must be recognized and protected.”   This would protect against the increasing court wrangling that finds liberal judges to overturn prolife legislation as unconstitutional. Otherwise, the door is open to undoing all prolife laws.

This is no idle threat since it is the exact ploy abortion activists are using to achieve an unfettered right to abortion. For instance, in Montana this year, two parental consent laws were struck down citing a constitutional right to privacy.

In ND last year, district court judge Wickham Corwin declared a law prohibiting off-label use of a drug to induce chemical abortions as unconstitutional. He cited a women’s right to liberty and the pursuit of happiness to unlimited abortion. “Our state constitution has always recognized liberty as one of the foremost of the ‘inalienable rights’ that must be zealously protected,” Corwin said.

Bishops David Kagan of Bismarck and John Folda of Fargo, reacted in a joint statement. “A lone judge sitting in Fargo declared that the North Dakota Constitution makes abortion a ‘fundamental’ right subject to practically no limitations,” they said. “The right ‘found’ by Judge Wickham Corwin is more expansive than that used by the U.S. Supreme Court.”

North Dakotans Against Measure 1 (NDAM1) are concocting lies to scare voters such as saying it will make contraception and in vitro fertilization illegal which is false. They incorrectly call it a personhood amendment; it is not for it does not provide rights to embryos. They claim it will ban all abortion. This is impossible until the US Supreme Court case Roe v Wade is overturned. There are also many, including a university law professor, falsely claiming the Measure will interfere with end of life directives which it will not. The latter scaremongers have zero experience with end of life issues but have long resumes fighting for abortion.

Bishop David Kagan of the Bismarck Dioceses appealed to voters not to be scared by all the lies. “This amendment will protect all of the real, common sense laws passed and now on the books here,” he wrote. “If you vote no, then you who are parents will not be able to be notified if your underage daughter is having an abortion; you who are senior citizens will not have the right to change your minds about the kind of care you want when you are sick or near death. A judge will decide that for you!”
