Canada Defeats Bill Saying Unborn Baby is a Human Being When a Pregnant Woman is Killed

Members of Parliament Wednesday voted 209 – 76 against Bill C-225, also known as “Cassie and Molly’s Law.”

This bill would have made it a crime to injure or kill a woman’s pre-born child during the commission of a crime against the mother. Currently, a pregnant woman victimized by violent crime has no recourse if her pre-born child is also injured or killed in that crime. Justice is, at best, only half served, and our elected officials have voted to keep it that way.

“This vote tells us that our Members of Parliament are unwilling to take a small step in increasing consequences for violence against women in Canada,” said Mike Schouten, director of WeNeedaLaw.ca. “They continue to ignore cries for justice and instead allow fear of the abortion discussion to colour their decisions regarding women’s health and safety.”

Schouten added, “Medical teams will fight to save premature babies, yet our criminal justice system will not take a stand against violence targeting pregnant women. This devalues the choice of the hundreds of thousands of women each year who desire to carry their child safely to term.”

It was clear early in the debate that the Liberals and NDP feared this bill would infringe on abortion rights. While a legal opinion provided to Member of Parliament Cathay Wagantall made it abundantly clear that this was not the case, they chose to be led by fear rather than looking at the realities.

MP Wagantall was deeply touched by the story of Cassie and Molly, a mother and pre-born daughter murdered in Ontario in 2014, and did all she could in bringing forward this bill and fighting for this cause. Tens of thousands of Canadians followed the progress and stood behind her in this fight.

But most importantly, Molly’s father, Jeff Durham, and grandmother, Nancy Kaake, poured out their hearts for this bill and saw justice denied them yet again.
